Judge says either DA Fani Willis or prosecutor Nathan Wade must step down in Georgia election case

In a significant development, the judge overseeing the Georgia election interference case against former President Donald Trump and his co-defendants has issued a ruling. While Fulton County District Attorney Fani Willis has not been outright disqualified, the judge has mandated that either she or prosecutor Nathan Wade must step aside from the case1.

In a detailed 23-page ruling, Judge Scott McAfee emphasized that “dismissal of the indictment is not the appropriate remedy.” However, he highlighted a significant appearance of impropriety within the current structure of the prosecution team. The conflict described by the defendants necessitates action to maintain the integrity of the case1.

The judge outlined two options for resolution:

  1. District Attorney’s Choice: Fani Willis may voluntarily step aside, along with her entire office. In this scenario, the prosecution would be referred to the Prosecuting Attorneys’ Council for reassignment.
  2. Prosecutor’s Withdrawal: Alternatively, Special Assistant District Attorney (SADA) Nathan Wade can withdraw. This would allow the District Attorney, the defendants, and the public to proceed without his presence or remuneration potentially compromising the case1.

McAfee clarified that the defendants failed to prove an actual conflict of interest on the part of the District Attorney. However, he stressed the need to address the appearance of impropriety. Trump’s lead attorney, Steve Sadow, expressed their intention to explore all legal options in their ongoing fight to end the case1.

While respecting the court’s decision, Sadow asserted that the court did not adequately consider the prosecutorial misconduct allegations against Willis and Wade. These allegations included financial benefits, untruthful testimony about their personal relationship, and Willis’ extrajudicial speech invoking race. The defense had also claimed that Willis intentionally prolonged the case to enrich Wade, an argument that McAfee rejected1.

In summary, the judge’s ruling allows Fani Willis to continue leading the prosecution, provided that the conflict is resolved by either her voluntary withdrawal or Nathan Wade’s withdrawal from the case2.
